1. Acceptance of Terms

By accessing and using the services provided by pigsinaptu B.V. ("Company," "we," "our," or "us"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms of Service apply to all users of our wellness studio, website, and related services located at Nieuwstraat 64, 5031 KG Tilburg, North Brabant, Netherlands.

pigsinaptu provides wellness and fitness services including:

• Personal training sessions
• Group fitness classes

4. Membership and Registration

4.1 Eligibility

You must be at least 18 years old to enter into this agreement. Minors between 16-18 may use our services with written parental consent and supervision.

4.2 Health Requirements

You must complete a health questionnaire and obtain medical clearance if required. You are responsible for informing us of any health conditions that may affect your ability to exercise safely.

4.3 Accurate Information

You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

5. Payment Terms

5.1 Fees and Billing

All fees are due in advance unless otherwise agreed in writing. Prices are listed in Euros (EUR) and include applicable VAT where required.

5.2 Payment Methods

We accept payment by bank transfer, credit card, and other methods as specified. Payment must be received before services are rendered.

5.3 Refunds

Refunds are available within 14 days of purchase for unused services, subject to our cancellation policy. Refunds for medical reasons may be considered on a case-by-case basis with appropriate documentation.

6. Cancellation and Rescheduling

6.1 Client Cancellations

Personal training sessions must be cancelled at least 24 hours in advance. Group classes must be cancelled at least 2 hours in advance. Late cancellations may result in forfeiture of the session.

6.2 Company Cancellations

We reserve the right to cancel services due to trainer illness, facility issues, or other circumstances beyond our control. In such cases, we will offer rescheduling or credit for future services.

7. Facility Rules and Conduct

7.1 Facility Use

• Follow all posted safety guidelines and equipment instructions
• Maintain cleanliness and hygiene standards
• Respect other members and staff
• Use equipment properly and report any damage immediately
• Wear appropriate athletic attire and closed-toe shoes

7.2 Prohibited Conduct

• Harassment, discrimination, or inappropriate behavior
• Use of alcohol or illegal substances on premises
• Solicitation or commercial activities without permission
• Photography or recording without consent
• Bringing weapons or dangerous items

8. Health and Safety

8.1 Assumption of Risk

You acknowledge that physical exercise involves inherent risks of injury. You voluntarily assume all risks associated with your participation in our programs.

8.2 Medical Clearance

You represent that you are physically capable of participating in exercise programs. We recommend consulting with a healthcare provider before beginning any fitness program.

8.3 Emergency Procedures

In case of medical emergency, we may contact emergency services and your emergency contact. You consent to necessary medical treatment in emergency situations.

9. Limitation of Liability

To the fullest extent permitted by law, pigsinaptu B.V. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.

Our total liability for any claim shall not exceed the amount you paid for the specific service giving rise to the claim.

10. Intellectual Property

All content, materials, and intellectual property provided by pigsinaptu, including workout plans, educational materials, and proprietary methods, remain our exclusive property.

You may not reproduce, distribute, or commercialize any of our content without written permission.

11. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated by reference into these Terms.

12. Termination

12.1 Termination by Client

You may terminate your membership or services with 30 days written notice. Termination does not relieve you of payment obligations for services already rendered.

12.2 Termination by Company

We may terminate your access to services immediately for violation of these Terms, non-payment, or conduct that endangers others or our business.

13. Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands.

13.2 Jurisdiction

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Tilburg, Netherlands.

13.3 Alternative Dispute Resolution

We encourage resolving disputes through direct communication. If necessary, disputes may be resolved through mediation before pursuing legal action.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services constitutes acceptance of modified Terms.
